Cabo Rental Villa Terms and Conditions

T & R Real Estate is the operator and owner of this website.

Reservations– Reservations are accepted with a valid credit card as a guarantee of deposit. Final payment is due 45 days prior to departure date. Final payment is due 60 days prior to departure date for holiday periods.

Confirmation Papers– Confirmation papers are normally mailed 21 days prior to departure. These documents will not be released until full payment is received.

Arrival and Departure Times- Check in is 3 p.m. Pacific Standard time and parties must checkout by Noon (12 p.m.) on the final day of stay. Parties needing exceptions are encouraged to call ahead and may ask for early or late arrival/departure times depending on Casa Gallucci's availability and vacancy.

Prices and Accommodation Substitution– All prices, amenities and services reflect current rates in effect and are subject to change without notice. T & R Real Estate reserves the right to make adjustments in prices if it is discovered that a particular price was shown or quoted incorrectly. Every effort will be made to provide services or accommodations of equal standard and quality for your safety, convenience and enjoyment. All prices are in U.S. Dollars ($USD).

Cancellations and Refunds– All reservations payments are non-refundable unless T & R Real Estate can re-rent the same property for the same period of time. Reservations that are re-rented are subject to a $50 cancellation fee. Holiday payments are non-refundable regardless of re-rental. Reservations may be re-scheduled (Same property and number of nights) up to 30 days prior to departure subject to a $50 re-scheduling fee and must be rescheduled within one year. After departure any un-used portion of your vacation is non-refundable.

Prices do no not include- Expenses and items not mentioned including but not limited to air transportation, tips for personal services, meals, beverages, parking fees, insurance, resort fees, telephone calls, laundry service, cleaning and other items of a personal nature.

Physical Disabilities– Mexico does not conform to the United States' American Disabilities Act standards and, therefore, facilities for disabled persons are extremely limited in Mexico.

Limitation of Liability– By booking one of these vacations, you acknowledge that in all events T & R Real Estate shall not be liable for any consequential damages and that the sole extent of T & R Real Estate liability shall never exceed the amount actually paid by you to T & R Real Estate. Each guest agrees on behalf of himself/herself (and your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge T & R Real Estate, its employees, agents, officers, directors, and shareholders from any and all claims or causes of action (known or unknown) arising out of the negligence of T & R Real Estate. This includes, without limitation, injuries or damages arising from T & R Real Estate's negligence which may occur on or about the accommodations, any activity engaged in by the guest, including but not limited to all activities listed above, and any negligent inspection, supervision, instruction, and/or maintenance of T & R Real Estate, breakdown in equipment, accident, sickness, Acts of God, strikes, theft, delays, inconvenience, construction, cancellations or changes in itineraries or schedules.
